Terms and conditions of personal data protection

Basic provisions

  1. The personal data controller referred to in Article 4 (7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter: „GDPR”) is Procentrum Design, Company ID: 25458060 based in U Kina 370,463 03 Stráž nad Nisou (hereinafter referred to as: "the Controller").

  1. Personal Data shall be understood as any information about an identified or identifiable natural entity; an identifiable natural entity is a natural entity that can be identified, directly or indirectly, in particular by reference to a certain identifier, such as name, identification number, location information, network identifier or one or more specific physical, physiological, genetic, psychological, economic, cultural or social identity of such natural entity.

Sources and categories of personal data processed

  1. The Controller shall handle the personal information you have provided to them or the personal information that the Controller has obtained based on your order.

  2. The Controller shall process your identification and contact details and data necessary for the performance of the contract.

Legal reason and purpose of personal data processing

  1. The legal reason for personal data processing is

  • the performance of the contract between you and the Controller pursuant to Art. 6 (1) (b) of GDPR,

  • the legitimate interest of the Controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6 (1) (f) GDPR;

  • Your consent with personal data processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6 (1) (a) of GDPR in conjunction with Section 7 (2) of Act No. 480/2004 Coll., on Certain Information Society Services, in the if no goods or services were ordered.

  1. The reason for personal data processing is

  • processing of your order and exercising the rights and obligations arising from the contractual relationship between you and the Controller; When ordering, personal data required for the successful execution of the order (name and address, contact information) is required, the provision of personal data is a necessary requirement for the conclusion and performance of the contract;

  • sending commercial communication and performance of other marketing activities.

  1. There is no automatic individual decision-making within the meaning of Article 22 of the GDPR on the part of the Controller.

Data retention period

  1. The Controller shall retain personal information

  • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the Controller and the exercise of claims under these contractual relationships (for 15 years of the termination of the contractual relationship).

  • for a period of time until the withdrawal of the consent with the processing of personal data for marketing purposes, which shall not exceed 15 years, if personal data is processed on the basis of a consent.

  1. When the personal data retention period has expired, the Controller shall delete the personal data.

Recipients of personal data (subcontractors of the Controller)

  1. The recipients of personal data shall include entities

  • involved in the delivery of goods / services / performance of payments on the basis of the contract,

  • providing marketing services.

  1. The Controller does not intend / intends to transfer personal data to a third country (a country outside the EU) or an international organization. The recipients of personal data in third countries are providers of mailing / cloud services.

Your rights

  1. Under the terms set out in the GDPR, you have

  • the right to access your personal data under Article 15 of the GDPR,

  • the right to correct your personal data pursuant to Article 16 of the GDPR, or to restrict data processing pursuant to Article 18 of the GDPR.

  • the right to have your personal data deleted under Article 17 of the GDPR,

  • the right to object to data processing pursuant to Art. 21 GDPR a

  • the right to data transferability under Article 20 GDPR.

  • the right to withdraw your consent with data processing in writing or electronically by sending such a withdrawal notice to the postal or e-mail address of the Controller specified in Article III hereof.

  1. Furthermore, you have the right to file a complaint with the Data Protection Office if you believe that your personal data protection rights have been violated.

 


 

VII

Terms and conditions of personal data security

  1. The Controller hereby declares that they have taken all appropriate technical and organizational measures to safeguard personal data.

Final provisions

  1. By submitting an order from the online order form, you hereby acknowledge that you have been acquainted with the personal data protection terms and accept them in their entirety.

  2. You agree to these terms by ticking the consent box via the online form. By ticking the consent, you hereby acknowledge that you have been acquainted with the personal data protection terms and conditions and accept them in their entirety.

  3. The Controller is entitled to change these terms. They shall publish the new version of the personal data protection terms and conditions on their website and at the same time they shall send a new version of these terms and conditions to your e-mail address that you provided to the Controller.

 

These terms and conditions shall come into effect on May 25, 2018.
